California ABC Type 02 Winegrower vs. Type 17/20 License: Which License Does Your Wine Brand Need?

Last reviewed: October 20, 2026

One of the first licensing decisions every wine business in Napa Valley and Sonoma County faces is choosing between a California ABC Type 02 Winegrower license and a Type 17/20 (Beer and Wine Wholesaler / Off-Sale Beer and Wine) combination license. While both license structures allow a California wine company to sell wine at wholesale to distributors/retailers and direct-to-consumer (DTC) within California, their eligibility requirements, tasting-room privileges, and multi-state shipping rules differ significantly.

Below is a practical side-by-side breakdown from Gateway Compliance Napa’s California ABC licensing practice.

1. California ABC Type 02 Winegrower License (Producers & Alternating Proprietors)

The Type 02 Winegrower license is California’s primary winery production license. Under California Business & Professions Code § 23358, a Type 02 licensee must hold a federal TTB Bonded Winery (BW) permit and actively produce wine—either at its own brick-and-mortar winery facility or as an Alternating Proprietor (AP) sharing a host winery’s bonded premises.

  • Core Production & Sales Privileges: Authorizes crushing, fermenting, cellaring, aging, and bottling wine; selling bottled or bulk wine to licensed wholesalers, retailers, and other wineries; and selling wine direct to consumers.
  • On-Site & Off-Site Tasting Rooms (Type 02 Duplicate): Authorizes on-site consumer wine tastings and retail sales at the licensed winery premises (subject to local county/city use permits), plus the right to hold one Duplicate Type 02 license for an off-site California tasting room.
  • Special Event & Estate Tasting Permits: Only Type 02 Winegrower licensees qualify for California ABC Winery Sales Event Permits and Estate Tasting Event Permits.
  • Nationwide Direct-to-Consumer (DTC) Shipping Eligibility: Because a Type 02 Winegrower holds a federal TTB Bonded Winery producer permit, it qualifies for out-of-state Direct Wine Shipper permits across virtually all U.S. states that allow winery direct shipping—including states that restrict DTC permits strictly to wine producers.
  • Ongoing Reporting: Requires regular TTB Form 5120.17 operational reports, federal Form 5000.24 excise tax returns, and California CDTFA Winegrower tax returns.

2. California ABC Type 17/20 Combination License (Custom Crush & Virtual Wine Brands)

What if you are launching a wine brand or négociant project where a custom-crush facility crushes, ferments, and bottles the wine on your behalf under contract? Because California ABC prohibits issuing a Type 02 Winegrower license to a company that does not control winemaking facilities and produce wine, non-producing wine brands apply for the Type 17 (Beer and Wine Wholesaler) and Type 20 (Off-Sale Beer and Wine) combination license under California Business & Professions Code § 25503.9.

  • Federal TTB Prerequisite: Paired with a Federal Wholesaler’s Basic Permit (and often a Federal Importer’s Basic Permit if importing foreign wines) rather than a Bonded Winery permit.
  • Premises Requirement: Can be licensed at a commercial office (including qualified home offices where permitted by local zoning), paired with a Type 14 Public Warehouse license at a commercial wine fulfillment/storage warehouse where taxpaid cased goods are stored.
  • Retail Condition (Internet, Phone & Mail Order Only): Under § 25503.9, the Type 20 license held in combination with a Type 17 carries a mandatory condition: retail sales to consumers must be conducted exclusively by internet, telephone, or mail order, with deliveries made from a licensed warehouse—no walk-in retail store or public tasting room is permitted.
  • Wholesale Bona Fide Engagement: To maintain the Type 17 Wholesaler license, California ABC requires the licensee to remain “bona fide engaged” in wholesale sales to licensed retailers or wholesalers in addition to its direct-to-consumer sales.
  • DTC Shipping Considerations: While a Type 17/20 licensee can ship directly to consumers inside California and in several states that accept non-producing brand owners or wholesalers, certain out-of-state DTC jurisdictions require the applicant to hold a federal Bonded Winery / producer license.

3. Key California ABC Application Filings (ABC-208, ABC-211, ABC-255 & ABC-257)

Whether applying for a new Type 02 or Type 17/20 license, or executing a person-to-person or premises-to-premises license transfer in the Santa Rosa or Sacramento ABC district offices, your application package must be carefully coordinated:

  • Form ABC-211 / ABC-211-A: Application for Alcoholic Beverage License and license transfer sign-offs.
  • Form ABC-208-A & ABC-208-B: Individual Personal Affidavits, Live Scan fingerprint clearances, and Financial Affidavit / source-of-funds disclosures for all required LLC members, corporate officers, directors, and trustees.
  • Form ABC-257 (Licensed Premises Diagram): Scaled site and floor diagram showing exact licensed boundaries, entrances/exits, bonded vs. taxpaid areas, and any shared AP zones.
  • Form ABC-255 (Zoning Affidavit) & Public Notice: Local city or county planning verification, 30-day on-site Notice of Intention to Engage in the Sale of Alcoholic Beverages posting, and certified mailing/newspaper publication where applicable.
